By accessing and using PitchPal ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. 2. Description of Service
PitchPal provides users with a service to automate online directory submissions using AI agents and human oversight ("the Service"). You understand and agree that the Service is provided "as-is" and that PitchPal assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. We do not guarantee acceptance by any third-party directory or any specific SEO outcome resulting from the use of our Service.
3. User Responsibilities and Conduct
You are responsible for all information, data, text, or other materials ("Content") that you provide to the Service. You agree to provide accurate, current and complete information as requested by the onboarding process. You agree not to use the Service for any unlawful purpose or in any way that might harm, damage, or disparage any other party. You are responsible for maintaining the confidentiality of any account information and are fully responsible for all activities that occur under your account.
4. Fees and Payment
You agree to pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. All payment obligations are non-cancelable and all amounts paid are non-refundable, except as expressly provided in our Refund Policy.
5. Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. PitchPal expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. In no event shall PitchPal, its officers, directors, or employees be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service.
6. Modifications to Service
PitchPal reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that PitchPal shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
